Unenforceable Contracts
When can a contract be unenforceable?
Statutes can say that certain contracts are not enforceable, like private betting contracts.
Courts look at the impact of a statute violation on the public welfare.
Courts would rule a murder contract void because it has an impact on the public welfare, even though a homicide statute doesn't enforce it.
Courts look at how directly the contract and the violation of the statute are connected.
They also look at how involved the parties are in the violation of a statute.
In the murder contract, one party murdered, and the other paid.
So they were deeply involved in the contract and will get in serious trouble.
