I have reviewed all the lower court decisions and appeals, as well as studying the history of naming for the last 1000 years.
At issue is whether a child of two unmarried people should take the name of the father or the mother, who in this case, is divorced from another man and retains his name. Whereas historically, the child usually takes the father's name, since the child has three half-siblings living with her with the mother's married name, I find it is in the child's best interest, to avoid confusion and embarrassment, to take the mother's married name.
I see this has been in courts for a number of years and I am glad for the chlild's sake, it is finally resolved.
Me too. Next week she registers for college.
